What to do if you’ve been injured
1. Retain quality legal counsel early in the process.
You will need your attorney to guide you through your claim process. The insurance company will try to get you on record without counsel and they will do everything they can to get you to sign a release on terms that are not favorable to you. Do not sign any documents without consulting your attorney.
2. Get evaluated by a medical professional.
You will need to have a medical consultation in order to substantiate your claim. Oftentimes, injuries to the back and neck are not visible and will not even show up in an x-ray. It is important to get thoroughly examined and if you are having significant pain in your back or joints, you should have an MRI. If you cannot afford medical care, we can arrange medical care for you with no upfront costs to you.
Why should I see a doctor immediately?
Delaying medical evaluation could cause more problems for you long term. Oftentimes, the initial pain you feel will not be that bad, due to a spike in adrenaline, but that could mask serious, lifelong injuries.
Through over a decade of representing injured individuals, we have seen many back and neck injuries become significantly more painful several days to weeks after the injury occurred. Many people take the wait-and-see approach to getting checked out, hoping some rest and ibuprofen will fix the problem, only to find a week or two later they are in significant pain. The insurance companies will absolutely use a delay in treatment against you and try to claim that if you were really injured, you would have gone to the doctor immediately.
Why choose Scofield Legal?
The vast majority of other personal injury attorneys have only ever represented plaintiffs, or the injured party. They have not defended these types of cases, nor do they have a solid understanding of how the case will be defended. Most personal injury attorneys have little to no trial experience and fold when the defense pushes back and demands a trial.
We understand how to properly evaluate personal injury cases from both sides because we have experience representing both plaintiffs and defendants in personal injury cases. Any lawyer can draft a lawsuit, but it takes time and experience on both sides of these cases to be able to truly and properly evaluate the strengths and weaknesses of a case. We know what the defense strategy will be because we have defended these cases as well as taken them to trial on behalf of injured clients.
Finally, a lawyer’s ability to get good results for his or her client rests largely in the ability to effectively take a case to trial and win. We have tried cases to verdict in numerous courts throughout the state with overwhelmingly positive results for our clients. Additionally, our winning reputation in the courtroom has made it possible for us to successfully settle hundreds of cases on very favorable terms for our clients without going to trial.
Personal Injury Plaintiff’s Attorney Fees
We handle all personal injury matters on a contingency, which means we only get paid a percentage of what we collect on your behalf. If we don’t collect, you don’t pay. Our contingency fee agreement is short and easy to read, and we will be happy to discuss it with you if you choose our firm to represent you.
